There is still the 2 months time limit on contingency orders in order to comply with the rules of exemption however it is now clearly stated that the dog will no longer be exempt if the requirements attached to the certificate of exemption are not complied with at any time after the certificate is issued, clarifying that breach of conditions will make your dog illegal again.

Tattooing has been removed from the conditions and replaced with microchipping. And you now have to provide access to the dog for the purpose of reading a microchip on request by a person specified in section 5(1)

It is now clarified that you now have five days to produce confirmation of insurance when requested to do so which matches the five days to produce already given to produce the certificate of exemption.

Seizures and destruction on Merseyside

Deed not Breed and Elliot Mather LLP are aware of the seizures made by Merseyside Police on the 27th March 2014 and that the dogs seized were subsequently destroyed.

It is believed that this action may be unlawful and the Police are to be challenged as to the legitimacy of their actions.

The advice to any owner of a pit bull type dog which has been exempted under the appropriate legislation is that the conditions as set out in the court order must be adhered to.

Failure to comply will result in the dog being re-seized by the police and as in the case of the dogs that were seized on the 27th March 2014 the dog may be destroyed.

We strongly advise you to check your insurance and make sure that it is up to date and that you have informed DEFRA. If you have insurance with Dogs Trust you have the responsibility to confirm to DEFRA that your insurance is in place every year, this is not done automatically.

Index fee increase

From 1st June 2013 the fee for adding a dog to the Index of exempted dogs will increase fom £24 to £92.40 PER DOG.

DEFRA have stated that any application recieved after 28th June will be charged at the new rate

HOWEVER, if the envelope and postal order are postmarked 27th June or earlier they will still accept the old rate of £24.

This is really important news for anyone currently going through the system or that has a dog that is awaiting seizure.
